This Case Went To a Judge On 12 October 2007 For Grounds For A Trial, It Is Now March What Is The Hold Up Portugal?

LISBON (Reuters) - Portugal’s public prosecutor on Tuesday passed the case against the parents of missing 4-year-old Madeleine McCann to a criminal judge who will decide whether there are grounds for a trial.
Kate and Gerry McCann were declared suspects in the case last week but were allowed to leave for England on Sunday.


"The case was submitted to the criminal judge who will decide on it at an opportune moment," a spokeswoman at the prosecutor’s office in the Algarve town of Portimao said in a televised statement.

The judge can decide there is enough evidence for a trial or reject the case for having insufficient evidence.
The spokeswoman gave no details of the evidence or what accusations the McCanns might face in the case involving their daughter’s disappearance from a hotel room in an Algarve resort on May 3.


But the prosecutor’s office said that the next steps in the continuing investigation, would be decided within 10 days, including any possible new measures against the McCanns.
In a statement, the Algarve prosecutor also said it was handing the matter to a more senior prosecutor in a neighbouring region, in a sign of the importance of the case.


Until last week there was not sufficient evidence to do anything other than name the McCanns as suspects, it said.

file includes the results of forensic tests of evidence taken from various sites in the Praia da Luz resort where Madeleine vanished and details of police interviews with the McCanns. They were both interviewed for several hours last week.
On his blog (www.findmadeleine.com), Gerry McCann denied any involvement in the disappearance of his daughter.


"We have absolute confidence that, when all of the facts are presented together, we will be able to demonstrate that we played absolutely no part in Madeleine’s abduction," he said.
"Kate and I are totally 100 percent confident in each other’s innocence and our family and friends have rallied round unflinchingly to support us. The pain and turmoil we have experienced in this last week is totally beyond description."


The forensic evidence may clear up whether Madeleine’s DNA was found in a car hired by the McCanns after she disappeared. Alipio Ribeiro, head of the judicial police investigating the case, said it was not conclusive.
Facing criticism that the investigation has been too slow, Portuguese Justice Minister Alberto Costa said the police force was "investigating with all its competence and with all necessary resources".


"I have full confidence in the police," he was quoted as saying by TSF radio.

After their daughter’s disappearance, the McCanns launched a high-profile publicity campaign across Europe to try to find her. Police have said they believe the little girl is dead.
With Portugal’s slow-moving legal system, where courts and prosecutors are overburdened with cases, the case could drag on for many more months, legal experts said.
Kate McCann told the Sunday Mirror that detectives had pressured her to confess to having accidentally killed her daughter.

It is Now March 2008 and still the McCanns are being kept totally in the dark about their daughter and about their position, surely their human rights are being abused. This is beginning to look extremely bad for Portugal and they are losing all credibility over the disgraceful way they have and continue to handle this case.

I've never posted on this blog before but I've been reading it for some time. I don't think you are doing Drs. McCann a favour by slighting the PJ and the Portuguese.
Drs. McCann received a great deal of support from the residents of P. da Luz and I am sure they wouldn't appreciate such derogatory comments. IMHO if you wish to support them as you say perhaps you should consider going down a different path.

to be honest we have quite a good idea of what the PJ have, which is a big fat zero, all the DNA tests are in now and yet they are faffing about asking the British police to ask questions of 3 of the friends.

If they had any evidence quite simply they would have charged them by now, after all let's be brutaly honest, it is what they have been wanting to do all this time isn't it?

Close this case up? Nice and neatly? No loose ends? Look it wasn't anything to do with Portugal, it was those nasty child killer McCann's, they killed their daughter, now they are going to prison so all the tourists can come back to Portugal.

As you said before, they made the McCanns arguidos before the law changed, as it has since been admitted they most likely would not have been made arguidos under the new law.

So why do they pursue the McCanns. They hope to get lucky. The PJ were gambling on getting more conclusive DNA evidence, which they didnt get. They probably thought they would because of Eddie but poor Eddie can only show indications of a corpse (and if I understand correctly, not a specific body ie cannot say it is Madeleine) and according to the article I posted a while ago, the dogs in that one were proven to be wrong 75% of the time (ie two correct hits out of eight indications).

The gamble hasnt paid off, because there is no evidence to find.

So, I tend to agree that if the Tapas witnesses are able to clarify their statement and nothing further arises from them, the case will be archived.

I do hope this is not 'shelved' conveniently. I somehow don't think all the countries now knowing what happened here will allow it to be....I hope not.

The most important thing to me to come out of this is that if Portugal is a member of the EEC they must act accordingly and in harmony with other countries. This sort of archaic secrecy drivel has to be stopped. A law for kids missing has to be enforced immediately, not at anyone's die=scretion IMMEDIATELY and any nannies have to be trained and clearly up to the job. The times of checking must be in line with any risk factors in the area, and any risks must be Made known in advance to anyone booking never mind ON THE HOLiDAY LOCATION itself. tOO LATE THEN ISN'T IT AS THE mCcANNS NOW KNOW. iF THEY CHECKED AS MUCH AS, OR MORE THOROUGHLY THAN, mw POLICY, THEY HAVE A CASE WHICH IS TO ME, WHAT LAST NIGHT'S PROGRAMME WA ALL ABOUT. dAMAGE LIMITATION, LEGAL REQUIREMENTS AND POINTING FINERS AT LAX SYSTEM OFmw. hOW SOON ARE WE GOING TO BE ABLE TO POINT THE FINGER AT LAX POLICING???

It is not the residents of PDL or the Portuguese people that we are criticizing, it is the PJ, because they are quite honestly and quite frankly useless.

Or do you think they have done everything right Alsabelia? That they haven't made a catalogue of errors and that they were not behind these disgraceful leaks that have turned these grieving parents into a side show for hateful freaks to hurl accusations and pure hatred at them?

We are not slighting the Portuguese people or in particular the residents of PDL. From what I hear the support received from the general public was very much acknowledged and appreciated.

I'm afraid where the PJ are concerned I make no apologies, they brought this on themselves by subjecting the McCs to the most horrendous of smear campaigns imaginable.

we are criticising an ongoing very long ongoing investigation. Not the Portuguese at all. Noone has said anything derogatory about them. We are however clearly perturbed at the length of time this case is taking, they are not charged, they are here in thiscountry unable to speak. This is torture in my view. Simple a that. Sadistic torture. Where else does this happen? It is ridiculous.

If they had evidence, strong evidence, they would be charged or 'and in jail now. they are NOT. Does that not say anything to you at all? They are not CHARGED they are suspects AS IS MURAT and we do not hear you miscalling the system there in Portugal regards him?

So balance your arguments please and read what we say, not what you want us to say because we did not.

Rosiepops, I really don't want to keep posting on your blog to be perfectly honest. It seems that the posters on this site don't really have a clue how to support Drs. McCann and are simply using this site as an excuse to hurl insults at the Police and Portuguese.
I'm not Alsabelia and have never been to her site although I have read a great deal about it on here. Can you give me the address?
If you wish to support Drs. McCann I urge you to look back at your own comments. The hatred towards the Portuguese that you spew out is by no means healthy and borders racism and I am sure Drs. McCann do not subscribe to it.

With all due respect to your opinion, the PJ,like police forces the world over, are not above public scrutiny and criticism. If worried about it, then they should hold a public inquiry into any questionable cases and their processes. That is how the criticism is silenced. Alternative is the introduction of a corruption commission where these things are given a public airing. Transparency is the key.

The portugese people are not the PJ and no intent on here to slight them in any way.

Maybe you agree that a couple that have lost their child should be subjected to such treatment, I dont. The PJ's life is not being affected by our criticisms, the McCs is and that is the big difference.

On Murat, I dont think there is any evidence there either, something strange but stange doesnt mean evidence. I prefer to use the innocent until proven guilty for Murat as well. But tell me, if released from arguido status, does it preclude them from being made arguido again at a later date if more evidence becomes available.

I do not see why Robert Murat has to be released from arguido status just because the McCann's are, they are not lumped together.

They will be released from the status because there is no evidence against them to keep them on it.

If there is no evidence to keep Murat as a suspect then he will be released too, but only on these merits.

IMO there are many questions for Murat and his associates to answer and they are not about time inconsistencies because someones watch was faster or slower, or because there was a group of friends coming and going at the table and people lost track.

The fact that I cannot understand is that despite all these witnesses coming forward to place Murat where he should not be and everything else that surrounds him and his friends, that the detective in charge Paulo Ribeiro having taken over this investigation over from a detective who himself is seriously implicated in another missing child case, that he has not asked to speak to this suspect again, it is incredulous!

Yes I take all your points even including Murat....although I do not like it at all. Yes,they need not necessarly be released of arguido status at same time.....but it does add pressure if done for one and not the other especially since Murat was suspect before the McCanns.

It was publised that Madelene's DNA was found in Mrs Murat's house. Clearly this needs further assessment.

Think about what it has been like to be accused of kicking the spinal fluid out of your own daughter. Think about what it has been like to live with the totally blood curdling and bizarre theories leaked to the press by PJ sources.

Hatred? No not hatred, you may hate the things that we are saying, but this is not hatred, this is you hating the truth.

Rather than come on here defending the PJ, you should be lobbying your government for an inquiry into the total shambolic and incompetent way your PJ have handled this investigation, you should be asking your government to set up an official inquiry into the scurrilous leaks coming from these PJ sources, designed to malign and denigrate a grieving couple. Now doing that to a couple in severe emotional trauma is hateful.

Once again, I am no expert in Portugese law but once released from arguido status, what is to stop them from talking. Surely if one group is released from arguido status than the other one must be as well, or else charged. Or else, who do you stop more press leaks, or even interference if the party was that way inclined.

I thought the same as Jane, that it was an all or no one scenario. But that is picked up from reading press articles, no other research. Does anyone know for sure?

not a clue. knitting fog again. I do not undestand why a person can be an 'in between' neither charged, nor innocent, a cloud yet not 'guilty' it is totally barbaric to me.

I thought if McC's were released of their status, then Murat's lawyer would ensure Murat was too as he was made arguiodo before them and similarly no further 'evidence'. However, I do remmber 2 major comments

1 They found DNA in apartment 5a 'where it should not have been'

2 DNA was found of Madeleine in Murats' mothers home where he lives. No further details on that either, but it was widely reported.

I can see why you say that, but surely they can release people they think from suspect status? I can't see how this would affect Murat, there was talk of Murat being released without the McCann's being released.

Don't get me wrong if they have nothing on Murat he should be released, I just think he has more questions to answer. He has allegedly given two false alibi's for a start and has a lot of questions surrounding him.
I do not want to see any innocent person suffer for something they haven't done, but I would be amazed if they set him free without questioning him further.

I am undecided about Murat but I agree that there has been questions raised about him (remember the two women that the anti's labelled old bats until the lawyer came forward and said he saw him as well) that need to be answered. I dont remember him being reinterviewed since those sightings of him were made public.

Also, Jane, I dont believe any press releases about Madeleine's DNA in Murat's house. I thought that it was denied by the PJ and there was nothing found in the house. And very difficult about DNA in the apartment, as many people have stayed there and remember it was used after the McCanns left. And another unsubstantiated press report.

No with Murat, it is where was he the night she vanished, why make up a false alibi and why deny talking to Malinka when the phone records show they had talked. Question, how do we know they talked and it isnt just another spurious press release.

No it was widely reported that Madline' dna was in Murat's house. Not just one paper.

the other comment was re dna in apartment 5a was 'where it should not have been' so who's dna was that? do they know as they could know but have not said. I do not understand, as I know it was also reported the bedding was NOT GIVEN for analysis. that is the first thing surely you would take. This blanket,,,,,surely there i some record of it??? It just does not add up at all.

I thought that DNA in Murat's house was reported in 24 Horas and was never substantiated. Big surprise eh? Nothing there so let's make up a story about it anyway, don't worry about the pain and grief they are giving people.

IMO there are questions for Murat to answer but to be fair again one of his friends gave Murat an alibi saying he was drinking with him in a bar and that Murat was drunk, this turned out to be completely untrue and the friend said he gave this alibi because he was scared the PJ were going to frame his friend!

Now the question you have to also immediately is why this friend should be under the impression that the PJ would try and frame Robert Murat?

I must say that giving a friend a false alibi that you haven't even seen that night and in a bar, is a pretty weird thing to do!

I think that both Murat and Malinka actually admitted later that they had spoken on the phone that night after saying that they had not, their excuse was they forgot they had spoken and the conversation was meant to be about some work that Malinka was doing for Murat's website.

janegt - I had read that too - the sheets had not been tested for DNA and I found that really strange.

At one point, I had heard or read there was DNA in Mr. Murat's house but when I mentioned it on the DE site - I was told that I was crazy and it never existed.

Just read Sky news. Yes, Martin is definitely puting a pro slant on it. Seems to be questioning the delay, implying the Lec Police are still looking for Madeleine. I agree with you.

But I dont think Martin was ever anti. I alwasy found him to be very balanced and trying to put both sides forward. Wasnt it him who said that it was further from the Tapas bar to the apartment (??? no of steps) than the McCanns said. But then he also said it only takes 1 minute. I think he tried to be objective.

The word 'eh' is used at the end of every sentence - drives me crazy.

I'm glad you got the same gist I did. I was absolutely blown away because Martin has not been writing too many articles. One night at DE - they were talking about Martin and how he had changed his tune going from pro to anti.

I find him to be a very unbias writer - always admired the way he as able to write a story without any particular slant.

I wish I could say I believed the PJ were continuing the search but I am not holding my breath, I have lost all faith I ever had in them.

I see the number of friends to be questioned has now jumped to 7 again.

It was good to get a direct quote from our police and let's hope this questioning takes place ASAP, although quite what this is going to do is a bit of a puzzle!

If I can be blunt here, I do not feel the PJ looked after the first 2 or 3 months max for Madeleine at all. So many reports, nothing done. Nothing followed up. Scandalous........

I despair of this standard of policing. It was a dictatorship until recently as seen by the standard of blogs....they seem dictator lead too......It just stinks. They may be 'gentlemen policemen with degrees' but no NO CAPABILITIES to find a missing child. It is not what did they do wrong, it is what did they do RIGHT?

It is good to see that what you glean from someone's voice, sentencing, stance, etc could be taken in a certain way. glad to hear it. I feel he took steps back not that he became an anti at all. Too much political influence in this case. He would shut up not put up if you know what I mean then watch like a hawk.

I still feel there is so so much we do not know that is not in the public domain. Will it ever be with this secrecy law? Hmmmmm.

They are certainly dealing with no mickey mouse outfit, with our Police.[In no way am I the sort of person who knocks johnny foreigner's police, but this particular branch of the Portugese Police have tried to weave a pack of lies and their bluff has been called.]

I am just back from posting a polite reply to doppeldaddto3 on Alsabelia's site, needless to say because she is scared of free speech and my particular brand of free speech that attacks her beloved PJ, she deleted the post. I made it under my own ID, was open about who I was, unlike her Daisy...roots visit earlier LOL I wonder if Alsabelia's old man was a dustman and that is why she chose the ID of Daisy? Oh well she can add that name to her portfolio of IDs, isn't it sad?

Would you believe that Doppel is over there stirring again? The man contributes nothing at all to the debate, just flits between blogs intent on causing blog wars pathetic person.

Apparently doppel is so narrow minded he fails to believe that I just happened to call in at a time when he made several posts intent on stirring up problems and then even he realised how pathetic he looked and deleted them and because I saw them I must be sitting looking at her blog all the time, like I am now I suppose?

Doppel you could not even tell the truth about how long those posts were left up there, arounf 15 mins I make it and NOT five as you stated.


Don't worry Alsadaisy/Leigh the choice of name did not go unnoticed, but don't worry I wont delete your posts, I'll let them stand, I wont try and gag you like you do to others and like your police do to innocent people with their barmy secrecy laws.

Melbel - thanks - I don't think it sunk in 2345. She believes what she wants to believe - I really have to quit going over there - I made that comment the other night when I was so upset and has Claudia called me a liar when I made a comment.

I just didn't like the way they were talking about another poor mom. Mind you, I don't think I would have left one of my daughters behind with a stranger. I don't know the whole sorry story, so won't judge her.

Did you happen to read the story on Sky News UK - Martin Brunt? It's pretty good.

janetgt - No, I never had the impression you thought Martin Brunt was anti. I think, one night,on DE - the antis were saying that he had changed his tune after the McCanns had been made 'arguidos' and they were so estatic. He had gone from a Pro to an anti - that certainly was NOT the impression I had in that article.
