Murat and Malinka

Let's not forget the other arguido in this case! Also let's see how many comments there are about this in the other blogs, all made by people who "never go to" our blog, yet spend all their time commenting on it.
______________________________

At 07:00 WEST on the morning of 14 May 2007, searches began at Casa Liliana, a villa owned by Jennifer Murat, a British citizen, near the apartment where Madeleine went missing.
Police and scientific teams sealed off the house, and at 16:00 the swimming pool was drained.
Three people, including Jennifer Murat's son Robert Murat, were questioned at the main police station in nearby
Portimão. Robert Murat, a frequent visitor to the villa who has dual British-Portuguese nationality, had drawn the suspicion of Lori Campbell, a Sunday Mirror journalist, who informed the police.

Former Murat classmate Gaynor de Jesus said: "I do know that he has been the official translator for the police."[32] Murat had said he was deeply concerned about Madeleine’s case because he had recently lost custody of his own three-and-a-half year old daughter who looked like the missing girl.

Robert Murat was given arguido (suspect) status on 15 May; before being given this status persons are treated as witnesses. It is not clear if Murat or the police asked for the arguido status which gives extra rights such as the right to remain silent.[6] Chief Inspector Olegário de Sousa told a news conference that an un-named 33-year-old (believed to be Murat) had been interrogated, but not enough evidence was found to justify arresting him. Sousa said police had searched five houses on Monday and seized "various materials" from the properties which were being subjected to scientific tests and had questioned two other un-named people as witnesses. Murat stated that he was being made a scapegoat so that the police could be seen to have found a suspect.

It was reported on 16 May that two cars used by the Murats had been examined, and computers, mobile phones and several video tapes were taken from their villa. It also emerged that a British architect who built the villa was ignored when he called police about a hidden basement within the property.

The police were understood to have taken in for questioning Sergey Malinka, 22, a man of
Russian origin, from whose property officers also took away a laptop computer and two hard drives. Malinka had set up a website for Murat and the two exchanged frequent phone calls since Madeleine's disappearance—the reason the authorities started suspecting him.Chief Police Inspector Olegário de Sousa reiterated there was insufficient evidence to make any arrests. Police said that Malinka had been questioned as a witness for approximately five hours, which did not, having regard to the "dynamic" nature of the investigation, mean that he could not become a suspect.

Malinka spoke negatively of the coverage of the case in the Portuguese media, which had alleged that he was a convicted sexual offender. Malinka denied he had contacted Murat, and said he was "completely innocent". Inconsistencies in his account of his relationship with Robert Murat emerged: he had said he had not contacted Murat in a year but Murat’s mobile phone records allegedly show he called Mr Malinka at 23:40 on the night Madeleine went missing. On
19 May, Portuguese detectives flew to England to interview Dawn Murat, the estranged wife of Robert Murat, and detectives re-interviewed other witnesses connected with Murat.

Murat was interviewed for a second and third time on
10 July and 11 July to clarify what detectives described as details and possible contradictions from his previous statement in the light of new information. On the second day detectives from the Polícia Judiciária questioned three friends of the McCanns who were dining with them at the time of the disappearance, Rachael Oldfield, Russell O'Brien and Fiona Payne, "to go over their accounts of events on May 3". The three were also brought face to face with Murat. As a result of the interviews, police examined discrepancies between statements from the three friends and that from Murat, in particular claims from the friends that they saw Murat outside the holiday complex on the night of the disappearance when he had stated that he was at home with his mother. Murat's mother, Jenny, subsequently corroborated his alibi.

Police, including British detectives, resumed searching Casa Liliana on
4 August. Vegetation was cleared and the grounds were searched but despite the use of hi-tech scanning equipment and a British sniffer dog no new evidence was found.

Reports in the Portuguese press suggested that Murat met Gerry while the latter was campaigning for the
Labour Party. Murat denied this on 13 September describing the reports as "absolutely ridiculous" saying "I’ve never met the man before".

I have an opinion on what the PJ have done. IMHO, the PJ had suspicions and no evidence (maybe just indicators that could be interpreted either way), so as the law was about to change, they pushed through the arguido status on the McCanns. Probably same for Murat (except I dont know why they were in such a hurry to make him an arguido, I would have thought they would do a bit more work first before making him known to the world).
So without evidence, they need a confession from either the McCanns or their friends. Neither will be forthcoming because one doesnt confess to something one didnt do.
I really think that the PJ thought they would get lucky and evidence would present itself. And it hasnt, because if they had real evidence, the PJ would charge them.
And unfortunately, if this was Aust, then the case would be subject to official scrutiny precisely because the laws were changing and the arguido status was set only days before the law changed. I doubt that such a thing will be overlooked by the Portugese Justice department. But I dont know how Portugal works but I do know that they have civl rights activists in Portugal.

Take this lawyer searching the dam at the moment. If he is a civil rights lawyer, as is indicated in the press, than he should actively work at this issue. This is something he could do to aid the McCanns and anyone else caught under the arguido laws.

Tinks, I saw on the other site that they had read my Afrikaans post. I was simply responding to their latest comments on me. Oh and they did ask me to tell you all that they are in fact two people so you mustn't be so paranoid! They also seem to believe that I would be translating their posts and carrying the content to you like a classroom snitch. I rather like that! Hey, miss!!

Dianeh,

I totally agree with you where the McCs are concerned. I do believe their status was rushed through before the law changed and I think Ribeiro knows this too.

I do lay much of the blame at the door of Amarel, who should never have been allowed to head this investigation in the first place.

Where Murat is concerned, I wouldnt necessarily say his status was rushed through, something must have lead them to dig up Casa Liliana not once but twice. Unfortunately the secrecy laws seem to have been applied to Murat more than they have the McCs.

Finally, I'm home after my meeting and social - wasn't bad - even decorating the eggs was fun - one decorated an egg like a Monet picture -- clever people.

I see there isn't a great deal of news. The PJ's may be coming after Easter - what a surprise that is! I'm beginning to think they are going to England via the Canadian route.

Diane, agree completely when you said the PJ's had rushed to make the McCanns 'arguidos' because of the changes being made to the laws and I don't think they had or even have very much evidence.

Just been to Skynews and read about that poor girl in GOA and the blame going to her mother. It got the better of me so I left a post.

In a nutshell. I am sick of everyone blaming the parents, ie McCanns, Shannon's Mum and this mother in Goa.

The men who committed the rape and murder are the only ones that are guilty. It doesnt matter whether the girl was alone or not. It doesnt reduce the guilt of these evil men who committed the crime. They are the only guilty people in my eyes. Just because there was an opportunity, they didnt have to take it. They are evil, evil men and they need to be severely punished. I feel when people blame the parents, they partly justify the criminals actions, when there is NOTHING that can justify or mitigate what they have done.

Diane - I'm back but I'm thinking of bed soon.

I had read about the GOA mom - and I didn't think it was looking very good for her. It's all very sad. I know 15 year old girls can be very difficult, so I certainly can't judge the mother's decision - perhaps the daughter had run away in the past and was threatening to do it again.

I feel like our society has gone a full circle. I remember when psychiatrists/social workers/,etc... were blaming the mother if their child did something wrong. I thought we were getting away from putting ALL the blame on mothers. It seems to me like we're back in that grove again.

I think most mothers do the best they can and there I go but for the grace of God.

Jane - pay no never mind to notdoc. Don't let him get you upset - you're too good for that. You're an excellent mom, a fair-minded person, intelligent and on top of that you're a great human being (okay go ahead and blush).

calcite51 said...

Diane, that must have been some comment you made - just tried signing on to Sky News and it is down.

HelenM - I apologize to you if I offended you with my comment about the Governor of New York. I do feel sorry for his wife and children but I don't feel sorry for him.

Michael Todd on the other hand - the press should leave him and his family alone - lots of people have affairs. I think the press should BUTT out of this one completely.

dianeh said...

On the Governor of NY. I dont even feel sorry for his wife. She stood beside him during his speech when he resigned. If that were my husband, I wouldnt even speak to him, let alone stand by him. I do feel sorry for the children though.

What amazes me (over and over by the way) is that these people take on the guise of morals crusaders and then do things like this. He obviously was only a morals crusader for the sake of his political career, not because of his own beliefs.

If he wasnt a morals crusader, I couldnt care less if he dressed as Mickey mouse for sex, let alone that he visited a very high priced escort. The reason for the high price is the guaranteed secrecy. He knew what he was doing was wrong and tried to hide it.

I believe in each to their own as long as they are not hurting others. But that Governor, he was forcing his own beliefs on others and then doesnt even stick to those beliefs. He should have just kept his morals to himself, as well as his ?????.

Hard, arent I? But he should have known better.

calcite51 said...

I agree Diane about the governor but his wife looked absolutely devastated, hurt and furious with him. I thought when I saw her, "That would NOT be me - I certainly would not be standing besides him."

Is it me or are the government officials becoming more brazen with their corruption garbage and yes, we have corruption amongst our politicians in Canada.
