Letters Rogatory - Where Are They Now?

To The Portuguese Policia Judiciaria, Please Take A Good Long Hard Look At The Face Of This Innocent Child, A Child That You "Know" Was Abducted From Her Bed In Praia da Luz On 3rd May - Take A Look And Then Examine Your Consciences, Bring Her Parents Torment To An End And Resume The Search For This Child. Excerpts translated from Jornal de Noticias

Kate and Gerry McCann will not be questioned again, when the investigators of Policia Judiciaria (PJ) travel to England, on the 7th of April, if (IF) Portuguese detectives travel to England as reported.

The Judiciaria wanted to, but the Public Ministry (PM) did not deem it necessary to hear Madeleine's parents, Madeleine disappeared in the Algarve, on the 3rd of May last year. Apparently according to this report, the PJ had prepared several questions that they wanted to ask Kate and Gerry but the Public Ministery allegedly removed the request from the list of priorities.

A source that is connected to the process explained that:

"the prosecutor understood that the diligence was useless and a waste of time, because the parents could refuse to answer the questions, according to the rights that the Portuguese law gives to arguidos".

That was precisely what the couple did when they were questioned by the PJ in Portimao, before they suddenly left for home, in Leicester, England, right after they were made arguidos.

"The couple never cooperated with the Portuguese police, in spite of what they publicly announce, through their spokesman. There were no guarantees that they would do so now, but in a criminal investigation, there are no absolute certainties. It was necessary to take the risk",

Apparent the JN was told that investigators were annoyed that they could not question the parents again.

Both the PJ and the Public Ministery have been criticised over the delay in writing and sending the rogatory letter to England. But JN knows that the document was changed several times.

It is also reported that among other factors, were new questions that were requested by the McCanns, through their lawyers, this a right that is given official suspects (arguidos) in Portugal.

Among the requests are the questioning of the psychologist who has been accompanying Kate, and the questioning of Justine McGuinness, a former spokesperson for the couple. These diligences were accepted by the Public Ministery.

Among other requests, the rogatory letter includes new questionings of witnesses, including the "Tapa 9" (the group of friends with whom the McCann's were spending their holidays in Praia da Luz), and the apprehension of Kate's diary.

When in England, the Portuguese investigators will only be allowed to accompany the performance of these actions, the questions will be asked in a set of interviews held by the local police.

The date that has been advanced for the trip has yet to be confirmed. The PJ awaits confirmation from Stuart Prior, the top senior official at Leicester police.

My Take:

Again we have an incredibly biased and slanted report from a Portuguese Newspaper, if by some remote chance that Kate and Gerry do stand trial in Portugal, the number one and overriding questions has to be:

  • Will Kate and Gerry McCann ever be able to have a fair and just trial?
  • Will Portugal be accused of allowing gross defamation of the characters of Kate and Gerry, by allowing the publication of gutter fast buck making books by ex arguido PJ officers?
  • Will the question of scurrilous leaks said to emulate from the offices of the Portuguese Policia Judiciaria be brought into question?
  • It is said that the Portuguese Prosecutor did not allow the re- question of Kate and Gerry because apparently they had already refused to answer questions in Portugal last September! Do you believe this is really the reason or is this just more spurious journalism carried out by Portuguese press with a chip on their shoulders?
  • Surely if investigators wanted to ask questions and it was legal to do so, they would ask them, so the question is why?
  • Why has the Portuguese prosecutor decided that no further questioning can be allowed at this time?
  • Could it be because under Portuguese law the PJ have absolutely no grounds to ask the McCann's these questions?
  • Bearing that in mind and also the sacking of disgraced detective Goncalo Amaral from this case and the haste in which the McCann's were made arguidos due to a change in Portuguese law, were there ever grounds to ask these questions?
  • Under Portuguese law apparently you have to have evidence to ask arguidos questions, does this mean there is no evidence to ask questions and was there ever any evidence to ask this couple questions?
  • Do you think it fair that this couple were made arguidos and under that status, were given certain rights and acting under advice given to them by their Portuguese lawyers and exercising their rights under Portuguese law, that this coupe are then defamed against in the Portuguese press for acting within their human rights under Portuguese law?
  • How did the press come to understand that such questions were asked and not answered?
  • Who is leaking from the offices of the PJ?
  • Should the Portuguese government now act to get to the bottom of the leaks that have mainly all turned out to be deliberate attempts to pervert the course of justice, which have allegedly come from a source from within the offices and ranks of the PJ?
  • Again another date the 7th April has been "leaked to the press" that the PJ are to travel to England to ask these now infamous set of questions which have been said to number between 4, 14, 40 and a 100
  • Do you believe that the letters are here in England as reported?
  • Do you think it right that the PJ and the Portuguese Attorney General's office have totally mishandled the deliverance of these rogatory letters, which have been said to be arriving here since last September 2007 and turn around and blame their apparent incompetence on the UK government, the McCann's, in fact anyone but themselves?
  • Again Portugal are pointing the finger at the UK and Leicestershire police, this time Stuart Prior seems to be the latest scapegoat to blame for these elusive "letters rogatory"
  • Laughably the JN is not also attempting to blame the UK for Portugal's incompetence, I ask
  • Just how much longer the UK government take a back seat and allow this farce to continue? And allow the human rights of two UK citizens to be abused in this way?

Is it time to start asking our MPs to act and ask questions in Parliament? Is it time to start lobbying the British government to put pressure on the Portuguese government to act? Apparently the front page apologies printed by the Express group newspapers has seen a revival in sympathy and donations into the the Find Madeleine Fund. Is it time to galvanise the support that is still obviously there for this couple and channel it to do something positive?

After all at the centre of this chaotic and farcical shambolic Portuguese investigation is a missing innocent little 4 year old girl and all these leaks and underhand tactics are seeking to divert attention away from this abduction of an innocent from her bed in Praia da Luz, Portugal. One question I would like to ask is why? Why are some people hell bent on diverting attention away from this fact by trying to lay blame of this abduction at the parents feet?

We just wanted to say that this was made by one of our regular posters 'Mum21' and we too thought it was a touching and poignant gesture and truly loving thought.

This is why we who moderate this board, do it because of the genuine and lovely natures of the people who post here and who never forget that in the middle of this terrible tragedy is a missing innocent 4 year old girl, her parents, grandparents, brother and sister and greater family.

And we are proud to moderate a board with such kind caring people.

Good Morning to everyone
The picture of Madeleine,is beautiful and also the Easter prayer, where we can all reach out,in our own way, to offer comfort to Madeleine's family and extended family and friends.
This is a brilliant analysis of where we are at and these probing questions need to be asked, of the Portugese.
I totally agree, that action is needed now, for our Government to get some sort of grip, of this situation, for the human rights of our fellow countrymen, are being abused big time.
When you read through all these issues and violations, it makes me remember how outrageous this circus is and how far short it falls, of acceptable standards, both legal and moral.
Who is doing the leaking and spinning, in the Portugese Police and why, has not the replacement Head of investigation, got a grip of the leaks, as he said he would do?
Who said that the PJ wanted more questions asked,but was not allowed,as the arguidos would not answer ?
I suspect that this is Portugese bluff and spin and these newspapers must forget, that we are a sophisticated nation and it will not wash.
I suspect, that the wise Portugese Judge, in view of the lack of evidence, knows this is going nowhere.

I feel that this blog is a group of warm hearted, individuals, from all over the world, with genuine concern for abused children and also,their abused and wronged families.
Even if I had the slightest suspicion about these people [ and my view is that this was an abduction], I would not join a hate blog, with people who use the language of certainty, when they have none.
In fact, they have nothing.
One poster, Wooram ?, is concerned that his or her human rights could be violated, if people are flushed out, from these hate blogs.
Do they not see any contradiction, in their violation of other people' human rights, by the use of such language, hiding under anonymity ?
I read back, the other evening,where people [as we are friends, here ]were sharing personal experiences about parents having died,etc, the sorts of agonies, that we have to fit into our lives.
Felicity, on her blog, could not help but snigger.
It is not that we have suffering, Felicity.
It is how we use it and you might reflect on the message of Easter.
Some people become twisted and I think that many antis, are in this category, and others can reach out, in love, to those who suffer.That is all.

Kate will not be reinterviewed and the 40 oh, so important questions will NOT be asked. Guess the questions were NOT that relevant to the case.

Of course, Kate would be free to go back to Portugal and answer the questions despite the fact that their lawyers are probably advising her NOT to.

As for Kate and Gerry not returning to Portugal on May 3 - can anyone imagine the circus that would take place in Portugal if they did return to Portugal? I concur with their lawyers - it's a bad idea.

Calcite I agree, the Mccann's will not be interviewed if the PJ ever find their way to England. In October last year the prosecutor refused permission for further interviews of the Mccann's to take place as no further 'evidence' had come to light. As far as we know that hasn't changed. I would think that there is always the possibility after the Tapas 3,4,5,6,7!!! have been re interviewed and any 'evidence' is brought forward that the PJ can go back to the prosecutor for permission to re interview. IMO some posters from other blogs are placing too much significance on these re -interviews, I think that they are in for a big fat disappointment.

How ludicrous (doing a CM here) for the Portuguese newspaper to suggest that there would be no point in asking the questions because the Mccann's wouldn't answer them!! Somehow I do not think that would go down well in court if this case ever goes there. IMO this aspect of the article does the PJ no favours at all.

I think it is interesting , if what has been reported is true, that the Mccann's have been allowed by law to request that certain questions be asked of existing witnesses and other named persons, i.e. Justine McGuinness and Kates pyschologist.IMO this can only work in their favour. Their defence will be able to counterbalance any 'experts' put forward by the PJ.

Many reports have been printed about the 'unbalanced' mind of Kate Mccann, using her diary as 'proof' of that. Again too much significance IMO of the seizing of this diary. The PJ if doing their job correctly will have to submit every piece of 'evidence' that they have (including the diary and not photostat copies) in order that the prosecutor can make an informed decision as to whether they have enough to actually secure a conviction.

As for the questions:

Funny you have not leaked what the questions are therefore one can only assume these questions were/are IRRELEVANT to the case.

And I do think it is a great idea for the lawyers to request Kate's psychologist and Justine be interviewed.

If I remember correctly, the psychologist was called in immediately after Madeleine's disappearance and she would have records of the state of mind Kate was in.

IMHO, the 40 questions are a joke just like the PJ's investigating skills.

Read on the other blog that Rat has risen again (how appropriate this happened at Easter). She was apparently in the hospital for a minor operation. Glad your operation was a success.

It will be interesting to see your court case, Rat. Will you start up a blog and keep us inform of the happenings? I wonder if CM will be questioned?

I think eventually, we will be seeing stronger laws about blogs and libel suits. This could be the beginning.

Agree with all you say and the main thing I keep thinking of,is Kate's mum,Mrs Healey,begging people not to daily crucify her daughter and son in law.
I hope, that from mid April, or whenever it is that they have to lift arguido atatus, it will be less of a distraction from their main task of finding their daughter.
Yes Calcite, the rat has, seemingly re appeared, but speaking for myself, I would be mortified if word got out, that I was subscribing to a hate blog and if correct, colleges and unis,are great talking shops and it would get out, to any outside area.
I am afraid that you reap what you sew and it is best just to comment on what has been proven to be correct, or you could get into all sorts of trouble !
I , too, would like these blogs cleaned up and some clarification, in law, about what is deemed acceptable, in terms of what you are allowed to say.
Like Rosie, I blame the DE, because, as Mum so wisely said, everyone's wanting to have their say, got totally out of hand.
They spawned hate sites and trial by media and fed lies to fantasists, who went on to weave their own lies and exaggerated theories.
When you think, they brought together people with extreme views, who would have been diluted, otherwise and maybe, just thought it, but not said it.
Alsa was saying earlier, that there are sites far worse than theirs and even she , has cried and felt sick.
I would never look at such a site, because what I saw on DE and on her's and Viv's, is quite bad enough for me.

I don't believe in convicting anyone by media or blogs and that's what they are doing.

I too blame the DE - they should have monitored comments better than they did. The personal attacks on commentors should NEVER, EVER have been allowed. I hope DE and the papers forced to apologize to the McCanns have learned an important lesson.

Well that has to be the lamest excuse I have ever heard, The Prosecutor has said it will be a waste of time asking the McCs questions because they could refuse to answer them! Oh come on, is that the best you can do!

So what he is really saying is, nothing has changed since he last ruled there was not enough evidence to warrant further interrogations.

Then why the bloody hell has he sat back and allowed his officers to continue with the leaks and the smears.

Enough is enough, get on with your face saving exercise and then for the first time in 11 months, do something for this ittle girl, release her parents from their hastily applied status and let them get on and do what you should have been doing and hopefully, I pray to god, it will not be too late.

Sadly, I read in Guardian that the "apology " has not dented the DE sales, rather increased it, unless they had not printed so many.
They make money, if they tell a pack of lies or not, it makes no difference.
It was said to be all marketing, though, with great pressure on the teams, to produce a McCann tale.
Super, I have just laughed to see, on Vile site, that you stand accused of doing research on Felicity's Polly Parrot !

What an absolute mess.

I always buy all the papers, specially at weekends, Sats/Suns and spend all day reading them with big pot o ground coffee. Not today. I have boycotted the Express and Daily Mail, so am stuck with the 'trash' and the Times.

I see interestingly though that MALINKA blames MURAT for his car being torched again, the 3rd time of late this has happened, and referring o the FALA in paint beside the car meaning 'talk'or 'speech' he said You mean Robert Murat.

It was Rosiepops who drew me into the DX HYS forum. I watched her fight her corner, on a very unlevel playing field (at times) and felt the need to throw my towel in alongside her. I subsequently met you all and have never regretted my actions.

Indeed, I feel like I have adopted another extended family, if that makes sense.

We live in a civilised society and most people can recognise that that particular publication, milked ever last penny our of little Madeleines plight. The parents did not ask them to do so.

At the end of the day, the Portuguese media have done all they can to promote the garbage theories put forward by pj via their leaks/sources.

In our bigotted country, it is not acceptable for the might of the press, to malign and accuse innocent parties of a crime, that even in their wildest dreams, the pj have not been able to do.

The compensation was peanuts - merely a token.

The apology was what was sought over and above everything else.

Maybe I missed one or two of the DX headlines but in all honesty cannot recall once where they accused the McC's of being guilty.
Like me and many others the DX may have questioned the McC's innocence but whatever language you translate that into it isnt an accusation of guilt!

The family are the victims of the DX multiple libels, yet they have not profited personally from same, but diverted the token damages, to the fund to find their missing daughter.

Who could possible criticise that - unless, they have the green eyes of jealousy interpreting same.

Nobody here knows the McCanns and so can’t answer your questions with certainty, but I would say that the suing of the Express and Star isn’t simply a money-making ploy.

It’s hard to see how the McCanns are personally benefiting from the fund – a couple of mortgage payments hardly amount to a major improvement in their lifestyle. And, boy, have they paid for it in other ways!

I can see why you are suspicious about the timing - only time will tell if your fears are with substance, when it becomes clear what this new cash injection is spent upon.

However, I would imagine the fund directors will ensure complete transparency in the certain knowledge that the fund will be thoroughly scrutinised by the relevant authorities.

Maybe the Fund did need a cash injection. It mainly seems to have been spent on people who have given little in return, but if onlookers are being honest, there is no evidence that it is going directly into the pockets of the McCanns.

I cannot personally see any good reason why Metado3 have had their contracts extended, and I think the Madeleine fund is a good earner for them, but the Fund Directors somehow seem happy with their work and they are in receipt of whatever progress reports the company have submitted.
