Madeleine McCann's parents to learn of case against them

By Natalie Paris and agencies

Last Updated: 2:19am BST 02/04/2008

The parents of Madeleine McCann could be given access to the Portuguese police's files on them within a fortnight, one of their lawyers has said.

Rogerio Alves said the police case against the McCanns could be made public on April 14, when the official secrecy period covering the hunt for the missing girl comes to an end.

The Portuguese lawyer said this period could only be extended in major inquiries, such as those involving terrorism and organised crime.

Portuguese detectives will travel to the UK on Monday to spend the week re-interviewing the seven friends on holiday with the McCanns when Madeleine went missing.

Kate and Gerry McCann, from Rothley, Leicestershire, remain formal suspects in the case but have not been charged and deny all wrongdoing.

Clarence Mitchell, the couple's spokesman, welcomed the lawyer's comments and called for the "arguido" status to be lifted.

Mr Mitchell said: "We would hope that the police will do the decent and proper thing and open up the files.

"I would go further than that, and say once they have completed the interviews with the the friends, they should go back to Portugal and assess the evidence and eliminate Kate and Gerry and allow everyone once again to concentrate on the search for Madeleine."

Hiya all
Just a flying visit, but sincere thanks for messages from everyone, about my new grand daughter, also the e mails and cards. Thanks,Isis, for kind words and message in Irish.
We are made up and thanks a million.

Not on long, but read back and noticed the Times article, posted by Chinadoll.
Seems very significant, to me and a totally different ballgame, from what we have been told,by the Portugese.
It sounds like the McC's legal team, are doing the pushing, to me.
I wonder if the PJ, would have come at all,if not pressed by the legal team, for parents.
It has taken them so long, to get their questions past the Judge, that there can be little, if any evidence.
It had not occurred to me,that the pressure was coming from our end.
When the Times, speaks,it will be sourced and substantiated.
Had a quick look at the other site, but they are getting more and more extreme and spiteful, some of them. The ones with young children, on 24/7, are neglecting their children, in my opinion.
I think they will blow themselves up, with hatred.
It was out of order, the gross lies about Rosie.
One of their posters,Hope or Wizard,if my memory is right, while on DE, put forward the idea, of the child's body, being cut up[hate to say this]and taken out. in pieces,in nappy.A very sick mind.
Noticed Mark posting and hope he gets over here.
Notdoc hates the fact that Mark knows so much more about forensics, than he can google.
Looked at Arsie's site and has the offensive letter, to Grandma Healey, gone from her archives ?
Maybe her solicitor, has warned her about offensive material.
Pity, that Mrs consecutive numbers, had delivered it.Should be named and shamed. Perhaps,it may not be much longer.
Am being heaved off computer, now,as we are having early night, as mother and baby are, hopefully home tomorrow.
Night and God bless and many thanks againx x x

Hi everyone,

Just in and noticed this from The Times Newspaper

This is an extract only:-

From The TimesApril 3, 2008

British police ready to question 'Tapas Seven' over Madeleine disappearanceDavid Brown
British police investigating the disappearance of Madeleine McCann are to interview more than 30 people who could help to prove that her parents were not involved in her abduction.

The interviews will begin next Tuesday with the first of the seven British friends who were on holiday with the McCanns when Madeleine was reported missing in Portugal. A different couple will be interviewed each day in the presence of Portuguese detectives at the headquarters of Leicestershire Police.

The officers will concentrate on alleged inconsistencies in the timelines of events on May 3. None of the witnesses will be made arguidos (official suspects under Portuguese law) and detectives will not seize evidence or search homes.

Madeleine's parents, Kate and Gerry McCann, both doctors from Rothley, Leicestershire, have offered to be reinterviewed but will not be questioned.

Thanks for reposting this China,

It is such a well informed article, note they will NOT seize any evidence. No surprise there then, you cant seize what doesnt exist.

chinadoll said...

As I said earlier, looks like the tail is wagging the dog

chinadoll said...
What I find interesting, is the wording in the first paragraph:-

'to interview more than 30 people who could help to prove that her parents were not involved in her abduction'

The article then goes on to say:-

'The list of people to be interviewed has been provided by Kate and Gerry McCann as part of their rights as arguidos to demand that police speak to people who could prove their innocence'

So, it would seem to me, that Portugal Minister who stated that the case was near an end, was probably inferring it was about to be wrapped up and imo the pj had no intention of coming over here to ask further questings.

It seems that the pj are coming here, at the request/demand of Kate and Gerry McCann - who are entitled to make such demands, as arguidos under Portuguese Law.

Hi

Just read back and in regards to the McCanns calling the shots about interviewing witnesses. I made a post (probably rambling) yesterday about it. In a nutshell I think this.

PJ have no evidence, so need to get a confession from the McCanns. With a confession, these 25/30 witnesses arent needed to make the case and also cant be used in McCanns defense. Without a confession, there is no case, so PJ never bothered to interview them.

Because if going to court, without a confession, everyone of those witnesses would be brought into court for the defence to raise reasonable doubt.

This is of course, all my own opinion.

Hi China

Diane,

Which explains why they are due to arrive - not by their own wind, but because Kate and Gerry, as arguidos are using the Law of Portugal to force their hand.

They really picked on the wrong family this time.

Hi Rosie, Tinks, Sass, Jane, Archer and anyone else I have missed.

Bring in on pj.

Get over here and do your job. You are required, by your own law to question the witnesses requested by the McCann arguidos - crack on and do it - in the presence of the Leicestershire Constabulary.

Note, any leaks after those interviews, will be rebuffed, because our police force will not tolerate underhand and illegal tactics of that nature.

I love the picture of your dog.

I went off to the dogs' home today to take out my usual hounds. One was already out and the other was in doggy hospital because she was sterilised yesterday, so I was dogless.

They asked if I would take out a dog I had seen on the website and I remembered the picture well. Looked to be about the size of a border collie. Great I thought and off I went to collect the dog.

Well when I got to his enclosure he was the size of a bl**dy donkey! He is an Irish wolfhound cross. I could have put a saddle on him and ridden him across the hills.

He's a lovely dog, very gentle but is useless on the lead. I swear I spent the whole time at a 45 degree angle leaning back.

Took him to an enclosure they have specially for the dogs to stretch their legs and run around in and he had a lovely old time running around with me, but the actual walk was not the usual length! How anyone manages to take a dog that size out and have any control at all is a mystery to me.

I wasnt offended and I can see that you also have a temper. Very justified the other night. There have been a few times when I just about lost it (my rag) but usually, I walk away from the computer before I post.

Wish I could do that in real life. My kids bear the brunt of my temper, as does my partner. As I have gotten older and the kids naughtier, my temper has gotten worse. Probably need the supernanny to come and help.

But as Kiwigirl said earlier, its Friday, and after baths and food, my partner and I will sit down for a few drinks this evening. Horror of horrors, a mother of two toddlers and I drink. Yes, but I dont write myself off. I do love a good Aussie wine.

Hi Sass

It must be good to work with the dogs like that. My problem is that I want to help all dogs and get upset when I see them not being looked after. I tried to report a neighbour when I lived in Brisbane because they had a yard about 3 metres by 3 metres with a quite large dog, that I never saw out of the yard in 6 months. It went in as a tiny puppy and I only ever saw it at the gate. I also believe it had no shelter and often had no water. But I couldnt prove it so the RSPCA did nothing. I was so upset, that I put a letter in another neighbours letter box to see if they could prove that it had no shelter etc. But I moved in the next few weeks and dont know what happened. Sass, the dog was so despondent it never even barked when I walked past with my two dogs. It still upsets me to this day.

Neighbours dog was in our yard this morning and attacked Cassie. Usually no problems but the other dog got near Cassie's food and it was on. She is now locked in the house. Muffy (the old dog) is much more even tempered, so there was no fighting there. Luckily Cass came inside when I called her. Much rather go to Mum than fight.

I love going there - I get there about 3 times a week (it's voluntary so there are no set times).

The first time I was a complete wreck. I took a little labrador cross puppy out and he was so trusting and I just wondered why he was like that. The woman who runs the dog part is great with them all (as are the people looking after them).

When I left the first time she had given me this dog to take out and he was all waggly tailed and happy and she said to him "bye bye poppet, have a lovely time". When we got back she was there again and said "hello poppet, did you have fun" and he was all waggly bummed again. It was such a nice "homely" touch. On the way out he was given a Schmacko (you probably know these doggie treats), so they have treats too.

We went past the pet memorial and all the names of the animals who died (they aren't put down if noone wants them) there are listed. That set me off as well. I was an absolute wreck, but I could see that they are all really well looked after and although it's no substitute for a proper home, it's not a bad place to be! It's clean and warm and they have people working there who genuinely love animals and who spoil them as much as they can!

that is correct, they will not. look at the way they have handled the Shannon case, thorough and diligent and I have a feeling more arrests to com.

not making someone a suspect and keeping them hanging on almost a year later and in the McCann's case 7 months, and still no charges, it is absolutely farcical, a shambles and it is about time the Pj got their arse in gear and sorted this mess out, if they are incapable then they have only to ask the British police to take the case over, I have a feeling the British police are itching to get their hands on this!

I wonder if the Leicestershire police will ask questions of their own? There are bound to be questions raised when people answer the PJ ones!

Do you know that not only does everything get written down in longhand during a police interview in Portugal, there is NO audio recording and NO video footage?

Talk about backward! What are they afraid of? All modern day police forces should have these simple assets, for 'everyones protection!

No one could say people fell down the stairs then!

but why oh why are the PJ and other countries perhaps too so far behind in not interviewing with video and translators immediately? Time is of the essence. This seems archaic to me just like their stupid secrecy laws. I can't understand how there is not a set down procedure for all countries, particularly in E.U. I just cannot comprehend what has happened here.

If only the pj had kept other options open and pursued same with equal vigour, as they have pursued the parents of little Madeleine.

So much wasted effort - and for what?

Saving face?

The whole sorry mess lies at the doorstep of the pj, they are truly unforgiveable.

They have no idea where this child is or what happened to her. All they ever had, was a hunch. They focused on the hunch and went searching for evidence to support it.

They will soon be required to put their cards on the table and the world will see that they NEVER had a case, they were just following their nose.........and just like the dogs, they got it all so very wrong.

dianeh said...

Good night Janet.

Take care.

dianeh said...

China

Agreed.

I read recently that most of the miscarriages of justice that have occurred in Britain (and probably same here) were because the police officers concerned (and not just one or two either) truly believed that the suspects were guilty. They then either concocted evidence, or failed to properly look at other avenues of investigation.

These police officers believed what they were doing were right and as the suspects were guilty. I think that the PJ (some of them) are having the same problem.

They really need to get outside help and do an external review of this case. Follow up with a public inquiry into the workings of the PJ and the secrecy laws, and the other issues that keep getting raised.

By the way, a little dove just crashed into our back glass door and broke its neck. It was so beautiful and it has upset me no end. My partner thinks I have lost my mind because it has made me cry. We are getting roman blinds and these have been delayed as couldnt get the material. They should have been here 2 months ago and if they had the dove would still be alive.

dianeh said...

China/Rosie

There is an article out this morning saying that it is quite likely that the arguido status for the McCanns could still have a while to go. It could be interpreted that their status only started in Sept when they were declared arguidos. But this doesnt make any sense because an extension has already been sort and granted once. So it doesnt make a lot of sense that after granting an extension that they turn around and change the start date.

Just need to wait and see I guess. Also, McCann lawyers would know this, so if it were true, why would they come out saying that the arguido status should be lifted in April.

chinadoll said...

Diane,

I will try to respond to your last post first.

You are correct that the arguido statust could be extended to September.

Alas, this would be a desperate measure and the last chance saloon for the pj. This, is, basically, the longest they can string it out.

From what I can gather, access to the files, under their secrecy laws, is a different matter and can only be extended in matters of national security ie terrorism or in the case of international organised crime.

Unless the pj concede that Madeleine was abducted and that her abductors could be part of an international child snatching organisation, then they have no grounds whatsoever, to extend that particular deadline.

They are running on borrowed time, one way or the other.

dianeh said...

Rosie

That explains it then. Still arguidos but with access to the files.

That does seem a bit strange doesnt it. And if no evidence (and looks increasingly likelly there is none),then the PJ will just look like fools if they extend the arguido status.

As I understand it, they can still investigate them and if they get further evidence the McCanns be reinstated as arguidos. So the PJ would be best to take that option.

Anonymous said...

Hello and Goodnight ladies !

chinadoll said...

Diane,

From what I have read, the pj have repeatedly refused assistance from outside police forces (from all over the world ie not just Europe)

They seem to want to maintain control of every aspect of the investigation and do not wish to share anything - other than amongst themsleves ie Christavoa and his ilk, who are given the green light to publish novels and fantasies about ongoing investigations and appeals of same (to which he, himself and his four colleagues, are arguidos)

With regards to the incident with the dove - that's life Diane, these things happen.

We have had wild ducks visit our garden for some years now. They appear early spring, mate and nest. The fox was a visitor early on and totally devastated the nest. We purchased a bespoke floating duckhouse to prevent a repetition and this has truly done the job.

When the ducks first started to nest, our 9 year old Staffy kept the fox and cats at bay. Unfortunately, she died the following year, when all the trouble started. Now, due to the floating duckhouse and our little girl Daisy (another Staffy) they are as safe as they can be in an urban garden.

To conclude, I know how you feel about the dove, alas, it cannot be helped. Sometimes they take off, because they are startled and blinds, or no blinds, their number is up.

Mother nature moves in mysterious ways.

Rosie has explained the secrecy thing and the arguido status. But I read this morning that arguido status and secrecy can be extended for a few more months, if the starting date is taken as Sept (8 months from there, and then a three month extension). Rosie doesnt think they will do this but I am not sure.

Will have to wait and see. Logic doesnt really seem to come into this, there is I believe ego's and national pride at stake which are resulting in the wrong decisions getting made.

We will have to wait and see. We will know soon enough. I take it a sign that arguido status will be lifted, after these inteviews, as per the reports coming out last month. But I dont want to get my hopes up.

The only hopes I want to get up, is that someone is getting close to finding Madeleine.

Diane,

Just to repeat what I said earier, but to ADD that the deadline for access to the files, runs out on April 14th or thereabouts.

Hence all the rush and panic to come over here and tie up all the loose ends. Only in cases of terrorism or international crime, can this particular law, be applied/manipulated:-

Diane,

When I say deadline to access to the files, I mean the secrecy law ie the files of the pj.

Entirely different to the arguido status - this is allowed to be held in place until September, at the discretion of the pj.

And it stinks.
