Gerry McCann has denied he received a string of mystery texts the day before his daughter disappeared in the Algarve.
According to court documents issued by Portugal's supreme court, police applied to seize his phone records after learning of the alleged messages. Investigators claim 18 text messages were sent to Mr McCann from an unidentified number around the time Madeleine vanished in Praia da Luz on May 3 last year. It is alleged that 14 messages were texted on May 2 and four more on May 4.
According to court documents issued by Portugal's supreme court, police applied to seize his phone records after learning of the alleged messages. Investigators claim 18 text messages were sent to Mr McCann from an unidentified number around the time Madeleine vanished in Praia da Luz on May 3 last year. It is alleged that 14 messages were texted on May 2 and four more on May 4.
But the McCanns' spokesman Clarence Mitchell said Gerry had no knowledge of the texts and received a handful of calls on his mobile in the days before his daughter disappeared. The documents reveal that public prosecutor Magalhaes e Meneses also sought access to text and phone messages from 10 mobile telephones thought to belong to the McCanns and seven of their friends.
He also asked for a full list of all the calls made between the group from when they arrived in Portugal on April 28 and when the McCanns left on September 9. But the supreme court issued a detailed ruling rejecting the application.
It also revealed that Kate and Gerry McCann could face charges of neglecting their daughter on the night she disappeared. The police inquiry also covers possible abduction, homicide and concealment of a corpse, the documents say.
But Mr Mitchell emphasised the court papers did not mean such a charge would materialise.
He said the couple vigorously denied neglecting Madeleine and welcomed the fact that abduction was also being considered by detectives.
He said: "This court document outlines the areas of the investigation and in no way suggests Kate and Gerry will be facing any such charges. Equally we have heard nothing officially to suggest any such area of investigation is being considered. However, we do note that abduction is apparently one of the parameters and we welcome that because that is what Kate and Gerry and their friends have said and that is what happened. If there is any suggestion of neglect charges being considered that will be vigorously denied because the legal advice that Kate and Gerry have received both in Portugal and Britain is that legally speaking everything they were doing that week was well within the bounds of responsible parenting."
A neglect charge carries a maximum penalty of 10 years. But it is understood for such a charge to stand up the prosecutors would have to show the McCanns intended to neglect Madeleine.

So the McCanns were made Arguidos on no conclusive evidence and without any analysis of their mobile phones records etc.
I see a "methodical approach" played no part in this investigation then!
Its time that the PJ lifted this ridiculous status which imo was a rushed decision, or to coin a famous phrase a "hasty" decision.
Why were they made Arguido's 8 days before a new law came in, where firm evidence would have been needed. People would have had to accept then that their status was justified.
To make them Arguido's when they did, smacks to me of a case that was floundering and rather than the PJ admit they were clueless and had made a hash of the investigation, they put these poor parents heads in the noose instead.
It is scandalous and inhumane treatment of a couple that imo are totally innocent and who relied and trusted in the PJ's help to find their daughter.
The PJ have imo hindered/denied the search for this dear little child from day one and I would like to know WHY ?

The giving and lifting of arguido status is up to the Prosecutor's office. The PJ have been investigating at the request of the Prosecutor's office and what the prosecutor's believes needs investigating.
If anyone can lift the status it would be the prosecutor's office. But like I said yesterday, this will not be done before the investigation is completed.

Forensic tests on the brother and sister of Madeleine McCann have shown that neither was sedated, it was claimed yesterday.
Portuguese newspapers have repeatedly alleged that hair samples from Kate and Gerry McCann’s children show that the couple sedated the two-year-old twins, Sean and Amelie, and Madeleine on the night that she disappeared.
But it is understood that the couple have commissioned their own tests, which found no traces of sedatives in hair samples from Sean and Amelie.
A source close to the couple said: “Any legal team worth their salt would have these kinds of tests done. No evidence of sedatives were found in the twins’ systems.”
Madeleine disappeared from an apartment in Praia da Luz, southern Portugal, more than five months ago. Experts said that traces of any drugs would be retained in their hair.
Rachel Woods, the general manager of TrichoTech, a private toxicology laboratory that carries out tests on behalf of the Home Office, said: “Anything that enters the blood-stream also enters the root of hairs and stays in the same position as the hair grows. If there was nothing found in the hair, that’s pretty clear-cut.” David Gerrie, an analyst at Guy’s Hospital Medical Toxicology Unit, said: “Traces will remain in the hair until it falls out or is cut. Hair grows at about 1cm per month so to test for five months ago you would need a 5cm-long hair.”
Kate and Gerry McCann, both doctors, have vehemently denied sedating their children and have threatened to sue Portuguese newspapers that carry such allegations.
Clarence Mitchell, a spokesman for the couple, said: “I’m more than happy yet again to confirm that Kate and Gerry have never used sedatives on their children. Any suggestion that they did so is both hurtful and defamatory.”

Of course the pj have a huge bearing on the direction of this case. They are trying to save face, not only for themselves, but for their country imo.
No, rosiepops, Mr. Amaral does not have the power to place arguido status on anyone. He was the sacrificial lamb chosen because many saw him as the weakest link, that is all. All the police officers can do is go to the prosecutor and say: we think this person should be made arguido. The prosecutor asks to see the "evidence" and "rationale" behind that information and then decides if they should charge with arguido status or not, and what type of measure to request (imprisonement until trial, identity and residence, domicile imprisonment, etc). In the case of imprisonments, a judge must decide if that happens or not. But if the Prosecutor does not want to prosecute, the PJ can say whatever they want that no one will be made arguido. It is not up to them. All they do is investigate and give the evidence to the Prosecutor's office for them to decide.

They were not refused the regular records (numbers called, received, date, time) that from what I read was allowed. So they would know how many calls were made and received, including messages, and the numbers that sent them but would not be able to officially use the content of those calls or messages.

How come the PJ were granted permission to see Robert Murat and sergy Malinka's records and not the McCann's? And why didn't they ask at the time and not leave it until december to request them?

No, the PJ cannot ask the prosecutor to lift arguido status and the Prosecutors can just lift status. It does not work that way. Perhaps that is why we constantly read in the papers saying the spokesman for the McCanns wants arguido status lifted. No arguido status is ever lifted until the end of an investigation even if people are innocent. But if people are innocent they do not need to worry. The case is investigated,there will be no evidence and at the end of the investigation, their status will be lifted.

"PORTUGUESE detectives have launched a major new operation in the hunt for Maddie McCann, it emerged last night.
They have seized phone records of thousands of residents of Praia da Luz and surrounding areas and are trawling them for “unusual activity” on May 3.
Officers are combing phone bills and questioning anyone whose phone use was out of the ordinary on the night the four-year-old disappeared.
Yesterday sources in Portugal said detectives are particularly interested in calls made between 9.30pm and 10pm when they believe she vanished.

A source said: “They are using a method of triangulation which pinpoints a person’s location via their mobile and are also checking land-line calls.”

Some 27,000 people live in the region and detectives are asking 1,000 residents to explain calls made at the time.

It was the content of the messages that the telephone companies were prohibited from providing for use at a trial. Obviously if the Mccanns never erased them and have them on their telephones still, they can use them.

Rosiepops, the PJ cannot ask anyone to lift the status. The status can only be lifted at the end of the investigation by the Prosecutor. Even if the PJ went to the Prosecutor today and said, we think the McCanns are innocent and want to follow this other line of investigation, they would remain arguidos until that other line was investigated. Imagine at the end, they discovered evidence that made them believe that person X was the culprit, then that person would be made arguido, the investigation would end, the other arguidos would see their status lifted and those charged would go to trial.
I am glad there is a tracker, that way I am sure you can confirm that I am in Portugal and end this silliness about me being in Australia.
